Terms of use
Welcome to Wander Off. These Terms of Use ("Terms") are an agreement between you and Wander Off Inc. ("Wander Off," "we," "us") and cover your use of the Wander Off app, the website at wanderoff.com, and the services we offer through them (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Please read the dispute resolution section below. It explains that most disputes will be resolved by individual arbitration instead of in court, and how you can opt out.
The Service
Wander Off helps you plan trips, book travel, and keep the photos and memories from your adventures. You can organize each trip as an adventure, add places by day, invite people to join, upload photos and videos, connect Google Photos, ask the AI Travel Concierge for ideas, make an adventure public, and copy public adventures that others share.
We are always improving the Service, so features may be added, changed, or removed over time.
How the Service is funded
The Service is free to download and use. We earn money when you book travel through Wander Off, through commissions or service fees from the travel suppliers we work with, and through any fee shown to you before you pay. We do not sell your personal information, and we do not use it to show you targeted advertising. Our Privacy Policy explains how we handle your information.
Your account
- You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live to book travel. If you are under 18, a parent or guardian must agree to these Terms for you.
- Give us accurate information, keep your sign in details secure, and tell us right away at mike@wanderoff.com if you think someone else has accessed your account.
- You are responsible for activity on your account. Usernames may not impersonate others or infringe anyone's rights, and we may reclaim a username that does.
- You can delete your account at any time in Settings.
Bookings and payments
- Suppliers provide the travel. Flights, hotels, tours and activities are provided by airlines, hotels and other travel suppliers, and are booked through our partners, including Duffel for flights, LiteAPI for hotels, and Viator for things to do. Wander Off is not the airline, hotel or tour operator. When you book, you also agree to that supplier's own terms, fare rules and policies, which control changes, cancellations, refunds, baggage and check in.
- Prices and availability. Prices, taxes and fees are shown before you pay. Prices and availability can change until a booking is confirmed. If a price is clearly wrong because of an error, we or the supplier may cancel the booking and refund what you paid.
- Payments. Card payments are processed by Stripe. By paying, you authorize the charge shown at checkout. We never see or store your full card number.
- Changes and refunds. Requests to change or cancel a booking are handled under the supplier's rules. We will help pass your request along, but refunds depend on what the supplier allows.
- Traveler details. You are responsible for entering correct names, dates of birth and contact details for every traveler, and for having valid passports, visas and other documents your trip requires.
Your content
- You own what you post. Photos, videos, captions, reviews, places and itineraries you add ("Your Content") stay yours.
- Permission you give us. So we can run the Service, you give Wander Off a worldwide, non exclusive, royalty free license to host, store, copy, resize, display and share Your Content, only as needed to operate and improve the Service and only with the people your settings allow. This license ends when you delete the content or your account, except for copies others already made of public itineraries and backups kept for a limited time.
- Public adventures and copying. When you make an adventure public, anyone can view its shared places and copy them into a trip of their own. Copies include the places, notes and ratings you chose to share, not your private photos. You can make an adventure private again at any time, which stops new views and copies.
- Your responsibility. Only post content you have the right to share, and get permission before posting photos of other people where the law requires it.
Google Photos and other connected services
If you connect Google Photos, Wander Off uses the permissions you grant only for the features described in our Privacy Policy: picking photos to add, saving full quality originals to albums Wander Off creates in your account, and viewing those originals. Your use of Google services is also governed by Google's terms. You can disconnect at any time in Settings or at myaccount.google.com/permissions.
The AI Travel Concierge
The Concierge uses artificial intelligence to suggest places, plans and options. Its answers can be incomplete or wrong, and opening hours, prices, safety conditions and entry rules change. Check important details with the supplier or an official source before you rely on them. The Concierge does not give legal, medical, immigration or financial advice.
Things you may not do
- Break the law, or help anyone else break it.
- Harass, threaten, impersonate or deceive other people.
- Post content that is illegal, hateful, sexually explicit, violent, or that infringes someone else's rights or privacy.
- Make fake bookings, use stolen payment details, or resell bookings without permission.
- Scrape, copy or collect data from the Service by automated means, or try to access accounts or systems you are not allowed to.
- Interfere with the Service, including by introducing malware or overloading our systems.
- Create accounts in bulk or hold usernames you do not use.
We may remove content or limit, suspend or close accounts that break these rules. You can report a problem at mike@wanderoff.com.
Our rights in the Service
The Wander Off name, logos, app, website and software belong to Wander Off Inc. or our licensors. We give you a personal, limited, non transferable license to use the app on your own devices for its intended purpose. You may not copy, modify, reverse engineer or resell the Service, except where the law allows it.
Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
Disclaimers
We work hard to keep Wander Off reliable, but the Service is provided "as is" and "as available." To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non infringement. We do not guarantee that the Service will always be available, error free or secure, or that content posted by other travelers is accurate. Travel carries risks, and you are responsible for your own decisions and safety.
Limitation of liability
To the extent the law allows, Wander Off and its officers, employees and partners will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. We are not responsible for the acts, omissions, delays or cancellations of travel suppliers. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid Wander Off in service fees in the 12 months before the claim, or $100. Some places do not allow these limits, so they may not fully apply to you.
Indemnity
If someone brings a claim against us because of Your Content or your breach of these Terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.
Ending these Terms
You can stop using the Service and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. Confirmed bookings stay subject to the supplier's terms. Sections that by their nature should continue, such as payments owed, disclaimers, limits of liability and dispute resolution, continue after these Terms end.
Dispute resolution
- Talk to us first. Most problems can be solved quickly. Email mike@wanderoff.com and give us 30 days to try to resolve it.
- Arbitration. If we cannot resolve it, you and Wander Off agree that any dispute relating to the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may still bring an individual claim in small claims court, and either of us may ask a court to stop infringement of intellectual property rights.
- No class actions. Disputes will be handled individually. Neither you nor we will bring or join a class action, class arbitration or representative action.
- Opting out. You can opt out of arbitration by emailing mike@wanderoff.com within 30 days of first accepting these Terms, with your name, account email and a clear statement that you are opting out.
- Governing law. These Terms are governed by the laws of the State of Illinois and applicable United States federal law, including the Federal Arbitration Act, without regard to conflict of law rules. Any claim that is not arbitrated will be brought in the state or federal courts located in Cook County, Illinois.
Changes to these Terms
We may update these Terms as the Service changes. If we make important changes, we will let you know in the app or by email before they take effect. If you keep using the Service after that, the updated Terms apply. If you do not agree, you can delete your account.
General
These Terms and our Privacy Policy are the whole agreement between you and Wander Off about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we do not give up the right to enforce it later. You may not transfer these Terms without our permission; we may transfer them as part of a merger, sale or reorganization.
